Schedule II Prescribing Returns to Pre-COVID Rules
You were recently advised by the State of New Jersey regarding telemedicine and prescribing Schedule II controlled substances (CDS). During COVID-19 (2020), temporary waivers allowed prescribing Schedule II CDS without an initial in-person exam and without in persona 90-day follow-ups.
With the State of Emergency recently terminated the waivers expired as of February 16, 2026, prescribers must return to pre-COVID requirements under N.J.S.A. 45:1-62(e): an initial in-person exam and in-person follow-ups at least every 90 days for Schedule II CDS prescriptions.
Existing minor stimulant exception: For patients under 18 prescribed Schedule II stimulants, in-person visits (initial and 90 days) are not required if the prescriber uses interactive, real-time, two-way audio and video technologies and obtains written parental consent.
Looking ahead NJAFP is considering asking the Legislature to extend this minor stimulant exception to adults, based on feedback from our members and discussions with other physician specialty societies.
These state requirements are mandatory and apply regardless of federal telehealth flexibilities.
