New Training Requirement for Observers (Chaperones) During Sensitive Exams

Correa BioNEW TRAINING REQUIREMENT FOR OBSERVERS (Chaperones) DURING SENSITIVE EXAMS

Effective April 18, 2026, the Board of Medical Examiners’ regulations will change as it relates to chaperone requirements for sensitive exams (breast, genitalia, rectal, and pelvic). The BME now uses the term “observers” and requires them to be trained and available upon request when sensitive exams are conducted. The BME adopted this change as a result of complaints against BME licensees for sexual misconduct.

A broad outline of the newly adopted changes to the observer rule requires licensees to:

  1. put up notice where exams are conducted advising patients of the right to an observer if they choose. (not in licensed facilities - hospitals or ASCs)
  2. get patient acknowledgement of notice signed every 12 months for each individual physician and maintained in patient’s medical record
  3. identify a trained observer(s) in the practice:
  4. Observer cannot be a family member of either the patient or the physician
  5. Observer does not need to be a licensed health care professional, but requires specific training:

The BME has a 2-hour training approved for an Observer to take for $55: Medical Chaperone/Observer Training Program • CTP-2.

Other approved options may become available

NJAFP is looking into negotiating a preferred group rate for NJAFP members staff with approved BME course vendors. More to come.
